Chapter 4 Outline answers to essay questions

Discrimination: the protected characteristics

‘Religious groups ought not to have to employ gay people if their religious beliefs do not accept homosexuality.’ (made-up quote)

Discuss.

  • You will want to start off by a discussion about the relevant parts of the Equality Act 2010 which, for the purposes of this essay, replaced the Employment Equality (Sexual Orientation) Regulations and the Employment Equality (Religion or Belief) Regulations and how the Act aims to protect from direct and indirect discrimination, victimisation, and harassment.
  • Then you will need to go on to the particular problem of when there is a clash between protecting people from discrimination on the grounds of their sexual orientation and the religious beliefs of organisations. To gain extra marks of course you should have read any academic articles available on this subject, perhaps by Professor Lucy Vickers. Then you would go on to discuss Part 1 of Sch 9 to the Equality Act 2010 and its provisions.
  • For more of these you should read Questions and Answers Employment Law 2018 by Roseanne Russell, published by Oxford University Press.
